Terms of Service
About these terms
These terms apply to your use of texnspex.com. They do not govern any specific engagement or client work — that is covered by the agreement signed for that engagement.
Use of the site
You may use this site to learn about our services and to contact us. You agree not to use it in a way that interferes with its operation, attempts to access it without authorization, or violates applicable law.
Services described on the site
This site describes services that Tex N Spex offers, including security assessments and vulnerability scans, cloud setup and migration, IT support and consulting, and web-presence work. The descriptions, packages, and prices on this site are starting points only. The actual scope, fee, schedule, deliverables, confidentiality terms, and limitations for any engagement are confirmed in a written engagement letter or contract that both parties sign before work begins.
No professional advice through the website
Information on this site — including service descriptions, FAQ answers, and any informational text — is general and for orientation only. It is not professional, legal, compliance, or security advice tailored to your specific environment. Do not rely on it as a substitute for a direct engagement. Always confirm in a written agreement what is right for your situation before acting.
No guarantee of breach prevention or perfect security
Cybersecurity is a continuously evolving field, and threats, attacker techniques, software vulnerabilities, and human factors change constantly. By their nature, security assessments, audits, scans, configuration reviews, and consulting work performed by Tex N Spex (whether described on this site, performed under an engagement, or otherwise) cannot and do not guarantee that your business will not experience a breach, ransomware incident, data loss, account compromise, regulatory finding, or other security event.
Our work is intended to identify, reduce, and help you manage risk based on the information available at the time of the engagement and the agreed scope. It is not insurance. It does not replace your responsibility for ongoing security operations, training, patching, monitoring, backups, and decision-making about acceptable risk. Specific limitations applicable to a paid engagement are set out in that engagement's agreement and supersede the general statements here.
Intellectual property
The site, its design, written content, and visuals are owned by Tex N Spex unless otherwise indicated. You may share links to the site and quote brief passages with attribution. For other uses, please ask.
Third-party links
Outbound links (for example, to Google Maps for reviews, or to a portfolio site) are provided as a convenience. We are not responsible for the content or practices of those third parties.
Contact form and communications
The contact form on this site is for prospective inquiries. Submissions are processed through a third-party service (currently EmailJS) and delivered to our inbox. Please do not submit passwords, financial account numbers, system credentials, or other sensitive data through the form. Communications received through the form are not, by themselves, a confidential or privileged channel — confidentiality applies once an engagement agreement and any required NDA are in place.
Disclaimers
The site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Tex N Spex is not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the site. Our total liability for any claim arising from your use of the site is limited to one hundred US dollars (US$100).
Changes
We may update these terms from time to time. The effective date above reflects the latest revision. Continued use of the site after changes means you accept the updated terms.
Governing law
These terms are governed by the laws of the United States and the state in which Tex N Spex is principally based, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless we agree otherwise in writing.
